Terms And Conditions :
If you access our app ARPAN SIR ACADEMY and/or OTS ARPAN SIR ACADEMY and/or website www.arpansiracademy.in (hereinafter referred to as “Website” or “App” or “ARPAN SIR ACADEMY”) You agree to be bound by the provisions of these Terms of Use. ARPAN SIR ACADEMY Institute proprietor’s decision will be binding and final in all matters. These Terms of Use, are between ARPAN SIR ACADEMY, and the User(s), who are registered or with us, or those who use ARPAN SIR ACADEMY as unregistered users (hereinafter referred to as “You” or “Your” or “User(s)”).
Please read these Terms of Use as they shall govern your use of ARPAN SIR ACADEMY App. By using or visiting including but not limited to Website, App or any products, software, information, data feeds, materials or services provided to you on, from, or through App (collectively the “Platform”) you signify your agreement to (1) these “Terms of Use”, (2) our Privacy Policy and (3) any other terms, guidelines, rules, additional terms of service, or other disclaimer & notices if any (“Additional Terms”). If you do not agree to any of these terms please do not use the Platform.
Platform :
The Platform includes all aspects of Arpan Sir Academy including but not limited to information, courses, software, App (Application) and services offered via ARPAN SIR ACADEMY.
The Platform provides, online video lectures etc. (hereinafter “Content”) submitted by the content creator (“Content Creator”).
Accounts/Registration :
ARPAN SIR ACADEMY requires you to register as a User by creating an Account in order to use all the features provided for in the Platform. We also allow restricted access to the Platform for unregistered Users. ARPAN SIR ACADEMY makes the Platform available to Users through the App if you have provided ARPAN SIR ACADEMY the requisite user information and created an account (“Account”) through the ARPAN SIR ACADEMY ID and password feature or other login ID and password, including but not be limited to a Gmail or Yahoo ID (collectively, the “Account Information”).
You will be responsible for maintaining the confidentiality of the Account Information and are fully responsible for all activities that occur in or through your Account.
Access to your Account shall not be given to any third-party. You hereby confirm that the Account created will always be used by you, ARPAN SIR ACADEMY reserves the right to terminate access to the account in the event it becomes aware that you have acted in the contrary.
You agree to immediately notify us of any unauthorized use of your Account Information or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this Point.
Eligibility :
You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use.
We reserve the right to refuse access to the Platform to any Users or to suspend and/or terminate access granted to existing registered Users at any time without according any reasons for doing so.
We provide these Terms of Use on our Platform so that you know what terms apply to your use. You acknowledge that we have given you a reasonable opportunity to review these Terms of Use and that you have agreed to them. You agree and acknowledge that your use of the Platform is subject to the most current version of the Terms of Use made available by ARPAN SIR ACADEMY at the time of such use.
Access, Permissions, Restrictions :
You agree to use the Platform provided herein only for purposes that are permitted by the Terms of Use.
You agree not to access (or attempt to access) the Platform by any means other than through the interface that is provided by us. You shall not use any deep-link, robot, spider or other automatic devices, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the App or Content, or in any way reproduce or circumvent the navigational structure or presentation of the website, materials or any content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the Platform.
Use of Content :
Except as expressly indicated to the contrary in any applicable Additional Terms, we hereby grant you a limited non-exclusive, revocable, non-transferable access to view the Content, in accordance with the Terms of Use subject to the following conditions:
A) You may access and use the Content solely for personal, informational, and internal purposes;
B) You may not modify or alter any Content made available to you; You may not distribute or sell, rent, license the Content available to others; and
C) You may not remove any text, copyright or other proprietary notices contained in the Content.
Content Creator and Ownership:
ARPAN SIR ACADEMY does not endorse any Content submitted on the Platform. ARPAN SIR ACADEMY expressly
disclaims any and all liability in connection with the Content. ARPAN SIR ACADEMY does not permit
copyright infringing activities and infringement of intellectual property rights on the Platform,
and we will remove all Content if properly notified that it infringes on another’s intellectual
property rights. ARPAN SIR ACADEMY reserves the right to remove any Content without prior notice if it
has reason to believe that the Content infringes any third-party copyright.
Termination of Account :
We will terminate a User’s access to the Platform, if
A) You breach any of the provisions of the Terms of Use, the Privacy Policy or any other terms,
conditions, or policies that may be applicable to you from time to time;
B) We are required to do so by law.
C) We have elected to discontinue, with or without reason, access to the App, the services
(or any part thereof)
D) Any act violates applicable laws.
We may suspend access to the Platform or require You to change Your password if we reasonably believe
that the Platform have been or are likely to be misused, and we will notify You accordingly. Any
termination of Your registration and/or Account or the Platform will not affect liability previously
incurred by You.
Effect of Termination :
If a User’s Account is terminated for any of the above-mentioned reason in such cases, we reserve the
right, in its sole discretion, to terminate or suspend the Account with immediate effect. Upon
suspension or termination of the User’s Account the User access shall be terminated immediately and
the user shall not be able to access the said terminated Account.
Copyright Infringement :
ARPAN SIR ACADEMY operates a clear copyright policy in relation to any Content alleged to infringe
the copyright of a third-party infringement.
If you believe that your work has been copied in a way that constitutes copyright infringement or
during your use you believe any Content infringes on any third-party copyright kindly contact us.
We have implemented procedures for receiving written notification of claimed infringements on the
Content uploaded on the Platform. If you believe in good faith that your copyright has been infringed,
you may provide us with a written communication which contains:
1.An electronic or physical signature of the person authorized to act on behalf of the owner of the
copyright interest;
2.A description of the copyrighted work that you claim has been infringed upon
3.A description of where the material that you claim is infringing is located on the website,
including the educator name, topic and any other detail identifying the infringing content
4.Your email address, your physical address and telephone number.
Disclaimer :
You agree that your use of the Platform shall be at your sole risk. To the fullest extent permitted
by law, the ARPAN SIR ACADEMY TEAM exclude all warranties, express or implied, in connection with the
services and your use thereof. To the fullest extent permitted by law, the ARPAN SIR ACADEMY excludes
all warranties, conditions, terms or representations about the accuracy or completeness of the Content or the content of any sites so linked and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies in the Content or any content on the company, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Platform, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our platform, (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Platform by any third- party, and/or (v) any errors or omissions in any Content or any other content or for any loss or damage of any kind incurred as a result of the use of any Content
or any other content that is posted, emailed, transmitted, or otherwise made available via the
services. The ARPAN SIR ACADEMY does not warrant, endorse, guarantee, or assume responsibility for
any product or service advertised or offered by a third party through the Platform or any hyperlinks
featured in any banner or other advertising, and the ARPAN SIR ACADEMY will not be a party to or in anyway be responsible for monitoring any transaction between you and third-party providers of products
or services. As with the purchase of a product or service through any medium or in any environment,
you should use your best judgment and exercise caution where appropriate.Fees once paid to the
ARPAN SIR ACADEMY will not be refunded in any circumstances.
Limitation of Liability :
To the fullest extent permitted by law, in no event shall the Arpan Sir Academy Team, be liable to you
for any direct, indirect, incidental, special, punitive, losses or expenses or consequential damages
whatsoever resulting from any (i) errors, mistakes, or inaccuracies in the Content or any other
content available on the platform, (ii) personal injury or
property damage, of any nature whatsoever, resulting from your access to and use of our Platform,
(iii) any unauthorized access to or use of our secure servers and/or any and all personal information
and/or financial information stored therein, (iv) any interruption or cessation of transmission to or
from our Platform, (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or
through our Platform by any third party, and/or (v) any errors or omissions in any Content or any
other content or for any loss or damage of any kind incurred as a result of your use of any content
posted, emailed, transmitted, or otherwise made available via the Platform, whether based on warranty,
contract, tort, or any other legal theory, and whether or not the ARPAN SIR ACADEMY is advised of the
possibility of such damages.
